Privacy Policy for Blaqcat Mobile App

This Privacy Policy describes how personal information is collected, used, and shared when you download and use the Blaqcat Mobile App (the “App”). It also explains your rights and choices regarding your information. Blaqcat (“Merchant”) is responsible for the personal information collected through the App. The App uses technology provided by Toast, Inc. (“Toast”). Personal Information Collected via the App
The App collects various categories of personal information. Contact information includes your name, email, phone number, and address. Orders and order history include details of items ordered, order dates and times, delivery addresses, tips, favorites, and order preferences. Payment information may include your card number, expiration date, and CVV, or alternative payment methods such as Apple Pay or Google Pay. If enabled, precise location data is collected to support location-based features such as nearby restaurant alerts and map views; this can be disabled in device settings. If you participate in rewards or gift card programs, the App collects related information such as points, redemptions, gift card values, and balances. Device and usage information is automatically logged and may include device type, browser, IP address, identifiers, language, carrier, general location, screen views, session duration, click behavior, and crash data for troubleshooting.

How Your Personal Information is Used
Merchant uses your personal information to operate and provide the App and its features, including authenticating access, managing accounts, processing orders, and delivering personalized content and notifications. Information is also used to recommend restaurants and menu items based on your preferences and past activity. To improve the App, your data may be analyzed to troubleshoot errors, evaluate performance, and support feature development. Aggregated or anonymized data may be used for analytics, forecasting, and business strategy. Merchant may use personal information for additional business purposes such as understanding customer trends, conducting market research, sending marketing messages, and advertising on third-party platforms. Information may also be used to comply with legal obligations, enforce terms, and investigate or prevent fraud and security threats.

How Your Information is Shared
Your personal information may be shared with Toast, which hosts and stores App data on behalf of Merchant. The App also shares information with service providers involved in its support and operations, such as hosting, communications, security, payments, and customer service. Merchant may share your information with partners for services like delivery and loyalty programs or for advertising through pixels and other tracking technologies. Information may also be disclosed to law enforcement or other authorities when required by law or necessary to protect rights or ensure security.

Your Privacy Choices
Within the App settings, you can access and update your account information. To delete your account, follow the instructions provided in the App. You may also manage privacy settings such as disabling advertising trackers. Additional rights may be available to you under applicable privacy laws. The App does not respond to “Do Not Track” browser signals. Changes to This Privacy Policy
This Privacy Policy may be updated at any time. Material changes will be communicated in accordance with applicable legal requirements.

California Addendum (CCPA)
This section applies to California residents under the California Consumer Privacy Act (CCPA). The App collects the following categories of personal information: identifiers such as name, email, and IP address; customer records such as contact details; commercial information such as transaction history; internet activity such as browsing and usage data; geolocation data if enabled; and inferred data for profiling and personalization. Categories not collected include protected characteristics, biometric data, professional or educational information, audio/visual data, and education records. Collected data is used to provide App features, personalize experiences, and troubleshoot. Data is shared with Toast and service providers. Sharing cannot be limited under CCPA for operational needs. Merchant may also use data for analysis, growth, market research, marketing, and legal compliance. Information may be shared with delivery services, loyalty program providers, and in connection with business transactions. Legal disclosures may be made when required.

California Privacy Rights
Under CCPA, California residents may have the right to request information about data collection and sharing practices, access their personal data, correct inaccuracies, or request deletion of information no longer needed. These rights are subject to CCPA limitations and exceptions. Requests may be made by contacting Merchant. Note that access requests are limited to twice in a 12-month period.

Sensitive Personal Information (California)
The App may collect sensitive information such as precise location (if enabled) and dietary or dining preferences that may reflect religious or health-related information. This information is used solely to personalize the App experience. Users may disable precise location via device settings or remove preference data from their profile. Under CCPA, California residents have the right to limit the use of sensitive personal information; however, Blaqcat uses such information only for permitted purposes.

Personal Information Retention (California)
Your personal information is retained for as long as needed to provide the App and for a reasonable time afterward to fulfill the purposes described in this Privacy Policy. Data is securely deleted or destroyed when no longer necessary, in accordance with applicable laws.

US State Law Addendum
This section applies to residents of Virginia, Colorado, Connecticut, Texas, Montana, Oregon, and Utah under applicable state privacy laws. These laws grant rights similar to CCPA, including the right to know about data practices, access, correct, or delete personal information, subject to specific limitations. Requests should be directed to Blaqcat via the contact information above. If unsatisfied with the response, users may appeal or submit a complaint.

Sensitive Personal Information (US States)
As with California, precise location data and dietary preferences may be collected with user consent and used solely to personalize the App. Consent can be withdrawn at any time through device or profile settings. Withdrawal of consent does not affect prior data use.

Personal Information Retention (US States)
Data is retained for as long as necessary to provide services and for a reasonable duration afterward for business or legal purposes. When data is no longer needed, it is securely deleted or anonymized in compliance with applicable law.
